EVRDECK, INC. · POLICIES

Terms of Service

Effective October 5, 2026 · Last updated October 5, 2026

1. Agreement and acceptance

These Terms of Service govern use of EVRDeck’s website and software subscription services provided by EVRDeck, Inc. (‘EVRDeck,’ ‘we,’ or ‘us’). The subscriber is the business identified in the accepted order or checkout (‘you’). A person subscribing for a business must be at least 18 and authorized to bind that business.

An inquiry or demo request does not purchase a subscription or authorize recurring charges. Before a paid subscription begins, the order or checkout must identify the locations, total amount, billing frequency, start or activation arrangement, these Terms, and the Cancellation & Refund Policy, and obtain your agreement and recurring-payment authorization. A separately signed agreement controls only to the extent it expressly addresses a conflicting provision. The Privacy Policy describes information handling.

2. What EVRDeck provides

EVRDeck provides web-based office operations software for California registration service businesses. Its workflows are designed to support quote and invoice preparation, financial reconciliation, document and bundle review, record organization, renewal follow-up, and recorded operating-credential dates. Features available to your location must be confirmed during the demo and in the accepted subscription order. Illustrative website interfaces are demonstrations, not live customer records or proof that every feature is available for every office.

EVRDeck is private software. It is not affiliated with or endorsed by the California Department of Motor Vehicles, is not a government agency, does not issue government documents, and is not an authorized DMV/BPA transaction-processing provider. It supports the work around your authorized provider; it does not replace that provider or process DMV transactions. The subscription does not include government fees, licensing services, provider access, or a guarantee of a license, approval, compliant file, financial outcome, or recovered customer.

3. Subscription price and automatic renewal

The standard subscription is $200 USD per month per subscribed business location. One location means one physical office identified in your order. Two subscribed locations cost $400 per month; three cost $600 per month, before any applicable taxes. The subscription is month-to-month with no annual commitment. Applicable taxes and any separately requested paid services must be disclosed before authorization; there are no undisclosed mandatory subscription charges.

Billing is monthly in advance. The first paid period begins on the activation date identified in your accepted order or checkout. We confirm the activation arrangement before collecting payment. Each location renews automatically for successive monthly periods until canceled. The recurring total and next billing date must be shown in your checkout, invoice, or subscription confirmation. Where a corresponding date does not exist in a month, renewal occurs on the last day of that month.

By affirmatively authorizing a recurring subscription, you authorize the disclosed monthly charges to the selected payment method until cancellation. Keep billing information current. Receipts or confirmations identify the charge and subscribed locations. Subscription charges are for EVRDeck software access, not customer DMV fees or provider transaction payments. Our software fee is separate from money collected by your office from its clients.

4. Activation, delivery, and support

This is a digitally delivered software service; no physical goods are shipped. Following the accepted order, we arrange onboarding and provide account-access instructions to your designated administrator. Any scheduled activation date, readiness condition, or delay is communicated before payment. We do not charge for access we have not activated. If a payment is collected and activation cannot be delivered as agreed, you may cancel and request a refund of the undelivered subscription period.

For onboarding, account assistance, billing, and support, contact admin@evrdeck.com or 323-421-7199. Business mobile contact is 818-319-8211. A subscription does not include a guaranteed response time, continuous uptime commitment, or custom development unless expressly agreed in writing. Maintenance, updates, and third-party interruptions can affect availability.

5. Cancellation, location changes, and refunds

You may cancel at any time by emailing admin@evrdeck.com or calling 323-421-7199. Provide your business name, account email, and the locations to cancel. A request received before the next renewal stops that renewal; no additional advance-notice period or cancellation fee is required. Cancellation takes effect at the end of the already-paid billing period, with access continuing through that period unless earlier closure is requested or lawful suspension is necessary. We provide confirmation of the effective date. Canceling one location leaves any other subscribed locations active.

Started monthly periods are generally nonrefundable and are not prorated for mid-period cancellation, unused access, or a change of mind. Exceptions include verified duplicate or erroneous charges, charges taken after timely cancellation, failure to activate the paid service as agreed, and refunds required by law. If we permanently discontinue paid service without your breach, we refund the unused prepaid portion. See the Cancellation & Refund Policy for request and processing details. Nothing here limits a nonwaivable statutory right or your right to raise a good-faith billing dispute.

Adding a location requires a separate confirmation of the additional recurring charge and its activation and billing dates. Price changes require at least 30 days’ advance notice and apply only to a future renewal; you may cancel before the change takes effect.

6. Accounts and lawful use

You are responsible for accurate account information, authorized users, appropriate access permissions, credential security, and activity under your account. Notify us promptly of suspected unauthorized access. You must maintain the licenses, permissions, and authorized provider relationships required for your business.

You may not submit unlawful material, access another office’s records without permission, misrepresent government affiliation, bypass access controls, introduce malware, interfere with the service, scrape private records, or use the service for unlawful marketing or communications. Do not resell access or reverse engineer the service except where law expressly permits. We may restrict access where reasonably necessary to address fraud, a security threat, unlawful use, or material breach.

7. Your records and customer responsibilities

You retain ownership of your submitted records. You grant EVRDeck permission to host, process, display, and transmit them only as needed to deliver, secure, and support the subscribed services and meet applicable obligations. You represent that you have the legal authority and permissions to provide those records and direct their processing. EVRDeck retains rights in its software, designs, documentation, and other materials.

You are responsible for the accuracy of source information, staff review of extracted or generated content, final invoices and reconciliations, filing and mailing requirements, record-retention obligations, and customer communication consent. Automated or AI-assisted outputs can be incorrect or incomplete. Verify results against source documents and official or provider requirements before acting. Software reminders do not independently verify government status or satisfy an obligation for you.

Keep appropriate independent copies of required business records. Before service ends, contact us to arrange retrieval of available data. Requests made within 30 days after service ends will be handled subject to identity verification, available records, legal holds, and the limitations explained in the Privacy Policy. Continued production access and indefinite storage after termination are not included.

8. Third-party services and payments

Your authorized processing platform, messaging services, and third-party checkout or payment providers have their own terms, fees, availability, and privacy practices. EVRDeck does not control their decisions, transaction approvals, withdrawals, or outages. Availability of an external feature depends on the relevant service and the permissions you grant.

Use only the payment methods offered in your authorized checkout or invoice. Do not send payment-card credentials, account passwords, or sensitive customer files through the public demo form or ordinary billing email. You remain responsible for agreed subscription fees; a payment-method update does not cancel a subscription.

9. Nonpayment, suspension, and termination

If a payment fails, we may notify you and request an updated payment method. We may suspend or terminate an unpaid subscription after notice and a reasonable opportunity to resolve the problem, except where immediate action is necessary for security, fraud, or legal requirements. Suspension does not authorize an undisclosed fee or restart a canceled subscription.

We may terminate for material breach, unlawful use, or a material security risk; where feasible, we provide notice and an opportunity to cure. We may discontinue service without cause on reasonable notice, stop future billing, and refund any unused prepaid period. Confidentiality, ownership, accrued payment obligations, applicable liability limitations, and dispute provisions survive termination to the extent relevant.

10. Confidentiality and service limitations

Each party must protect the other party’s nonpublic business information using reasonable care and use it only for the relationship or as permitted by law. Disclosure to personnel, providers, or advisers must be limited to those with a legitimate need and appropriate confidentiality duties. This does not restrict information already public without breach, independently developed, lawfully received, or required to be disclosed by law.

To the extent permitted by law, the service is provided ‘as is’ and ‘as available.’ We disclaim implied warranties of merchantability, fitness for a particular purpose, and noninfringement. We do not guarantee uninterrupted or error-free operation, complete document extraction, compliance, revenue, savings, or an individual business result. This disclaimer does not exclude warranties or obligations that cannot lawfully be excluded.

11. Limits of liability

To the extent permitted by law, neither party is liable to the other for indirect, special, incidental, punitive, or consequential damages, or lost profits or business opportunities arising from these Terms. Each party’s aggregate liability arising from the service is limited to the subscription fees paid or payable by you in the 12 months preceding the event giving rise to the claim.

These limits do not apply to fraud, willful misconduct, gross negligence, amounts owed for services, or liability that applicable law does not permit to be limited. They do not reduce a required refund or other nonwaivable remedy. Each party remains responsible for its own conduct; these Terms do not impose an automatic obligation on you to defend EVRDeck against every third-party claim.

12. Governing law, disputes, and changes

California law governs these Terms, without applying conflict-of-law rules, subject to mandatory protections under applicable law. The parties will first attempt to resolve a dispute through admin@evrdeck.com. Unless applicable law requires otherwise, court proceedings will be brought in the appropriate state or federal courts in Los Angeles County, California. These Terms do not require arbitration or waive a right that cannot lawfully be waived.

Material changes to subscription terms receive at least 30 days’ notice before applying to an existing subscription, unless a shorter period is legally required. You may cancel before the new terms apply. Website terms may be updated by posting an updated date. A provision found unenforceable is limited or severed without invalidating the remaining provisions. Failure to enforce a provision is not a waiver. These Terms and your accepted order form the agreement for the service, subject to any separately signed agreement.
